INFORMATION ON THE PROCESSING OF PERSONAL DATA
Tanfer Hastanesi Sağlık Hizmetleri San. ve Tic. A.Ş. (“Tanfer Hastanesi”) has the title of “Data Controller”. Your personal data will be collected, recorded, updated as described below; can be disclosed, transferred, classified to third parties where permitted and/or required by legislation or agreements in accordance with the Law on the Protection of Personal Data numbered 6698, Regulation numbered 29863, Healthcare Services Basic Code numbered 3359, the Governmental Decree-Law on Organization and Duties of the Ministry of Health and its Affiliated Companies numbered 663, the Private Hospitals Regulation, and other regulations of the Ministry of Health, and other applicable laws and provisions.
1- TYPES OF PERSONAL DATA PROCESSED
- Personal identifying information: Your first name, surname, Turkish Identity Number, (for non-Turkish passport number or temporary T.C. Identity Number), birth date and place, marital status, gender information, photocopy of T.C. Identity Card, driving license or passport and other identity information that may be helpful in your identification,
- Communication information: Your address, telephone number, e-mail address,
- Accounting information: Your bank account and IBAN number, credit card data, your financial information regarding payment and invoicing,
- Health information: Your personal data about your health and sexual life acquired and collected during provision or as a result of medical diagnosis, treatment and care services, patient number and protocol number, including, but not limited to, your laboratory and image results by the external institutions, test results, medical examination data, prescription data,
- Your private health insurance data and Social Security Agency data,
- Your camera recording, image and voice recordings of the close circuit camera system in the general areas of the hospital,
- Your personal data obtained when you contact us via e-mail, letter or another way, your suggestions, comments and survey responses that you share to evaluate our services,
- Appointment data,
shall be recorded and processed in accordance to the conditions stipulated in Law on the Protection of Personal Data numbered 6698.
2- PURPOSES OF PROCESSING PERSONAL DATA
Your personal data obtained by Tanfer Hastanesi, listed above, may be processed for the following purposes:
- For confirmation of your identity; fulfillment of legal requirements determined by legal regulations, monitoring and preventing abuse and unauthorized transactions,
- Sharing of information with the Ministry of Health and other relevant public entities and administrations,
- Keeping you informed about your appointment at Tanfer Hastanesi,
- Measurement, enhancement and study of patient satisfaction,
- Participation in campaigns and disclosure of campaign information, and designing and transmission of special contents, and discrete and abstract benefits in web and mobile channels, by Marketing, Media and Communication, and Call Center departments,
- For protection of public health, preventive medicine, medical diagnosis, treatment and maintenance services
- Planning and management of internal operations by the management of Tanfer Hastanesi,
- Financing of your healthcare services and payment of your medical examination, diagnosis and treatment cost,
- Sharing of your information with private health insurance firms if the cost are covered by your insurance
- Performance of analyses for further development of healthcare services, performance of risk management and quality improvement activities,
- Issuance of invoices for the services provided to you,
- Responding to all your questions and complaints regarding our health services,
- Taking all necessary technical and administrative measures within the scope of data security of our hospital’s systems and applications.
Your personal data, obtained and processed in pursuant to the applicable laws and regulations, may be transferred to physical achieves and/or information systems of Tanfer Hastanesi and may be kept and stored both in digital and physical platforms.
3- TRANSFER OF PERSONAL DATA
Your personal data may be shared by Tanfer Hastanesi with companies within Tanfer Health Group or with private insurance companies, Ministry of Health and its sub-units, Social Security Agency, Security General Directorate and other security forces, General Directorate of Populations and Census, Turkish Pharmacists’ Association, courts and all kinds of other juridical authorities, central etc. third parties, your authorized representatives and agents, and third parties offering consulting and advice services to us, including, but not limited to, lawyers, tax and financial consultants and auditors, and our business partners and other third parties acting in cooperation with us for further development or performance of healthcare services for the purposes cited above, also including regulatory and supervisory bodies and authorities, and official authorities, for the purposes of processing listed above, in accordance with the Law and other applicable laws and regulations.
4- METHODS AND LEGAL CAUSES OF OBTAINING PERSONAL DATA
Your personal data are collected and processed in all kinds of verbal, written, visual or electronic media, for the purposes listed hereinabove, and for the performance of all kinds of works included in the fields of business of Tanfer Hastanesi within the legal framework, and accordingly, for full and proper performance of all kinds of contractual and legal duties and obligations of Tanfer Hastanesi.
In accordance with the Law on the Protection of Personal Data numbered 6698, in the event of one of following conditions, it is possible to process personal data without seeking the express consent of the related person.
- If clearly provided for by the laws,
- If mandatory for the protection of life or physical integrity of the person or of any other person who is bodily incapable of giving his consent or whose consent is not deemed legally valid,
- If processing of personal data belonging to the parties of a contract is necessary provided that it is directly related to the conclusion or fulfilment of that contract,
- If mandatory for the controller to be able to perform his legal obligations,
- If the data concerned is made available to the public by the data subject himself,
- If data processing is mandatory for the establishment, exercise or protection of any right,
- If mandatory for the legitimate interests of the controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.
In addition, your personal data relating to health and sexual life may only be processed, without seeking explicit consent of the data subject, by any person or authorized public institutions and organizations that have confidentiality obligation, for the purposes of protection of public health, operation of preventive medicine, medical diagnosis, treatment and nursing services, planning and management of health-care services as well as their financing.
5- YOUR RIGHTS REGARDING PROTECTION OF PERSONAL DATA
By applying to our Health Organization within the scope of Article 11 of the Law on the Protection of Personal Data; you may learn whether your personal data are processed or not, if your personal data are processed, you may request information relating thereto, you may learn the purpose of processing of personal data and whether they are used for the intended purpose or not, to learn whether personal data has been transferred, if transferred, you may learn the 3rd parties your data are transferred to, if your personal data are processed incompletely or wrongly, you may request correction or completion of them, you may request the erasure or destruction of your Personal Data under the conditions laid, you may request to forwarding the correction and deletion transaction of personal data to the third party to whom the transfer is made, you may request compensation for the damage arising from the unlawful processing of his personal data.
